Welcome to Affordly! These Terms of Service ("Terms") govern your use of the Affordly mobile application ("App") and any related services provided by Affordly ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 18 years of age to use Affordly. By using the App, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the App under any applicable laws

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

Some features of the App require you to create an account. When you register, you agree to:

• Provide accurate, current, and complete information (including a valid email address)
• Verify your email address when requested
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

By creating an account, you agree to receive transactional emails from us, including:

• Verification emails: To confirm your email address during registration
• Password reset emails: When you request to reset your password
• Account notifications: Important updates about your account status
• Support responses: Replies to your support inquiries

These are transactional emails required for the service to function. We do not send marketing emails without your explicit consent.

Affordly is a grocery receipt scanning app that:

• Uses optical character recognition (OCR) powered by Google Gemini AI to extract items from receipt photos
• Categorizes your purchases into spending categories (Produce, Dairy, Meat & Seafood, etc.)
• Generates AI-powered, actionable savings tips personalized to what you bought
• Provides a visual spending category breakdown for each receipt
• Stores your scan history securely on our servers for easy access

6. AI Savings Tips Disclaimer

Savings estimates (e.g., "could save 20-30%") are approximate ranges based on general market knowledge. Actual savings will vary depending on your location, store availability, and current prices. Always use your own judgment when making purchasing decisions.

7. Acceptable Use Policy

You agree to use Affordly only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any local, state, national, or international law
• Upload receipts that you do not have permission to use
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the App or servers
• Use automated scripts, bots, or scrapers to access the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices
• Use the App to collect data about other users without consent
• Impersonate any person or entity
• Upload malicious code, viruses, or harmful content
• Create multiple accounts to abuse the free tier

8. Intellectual Property

The App, including its content, features, functionality, design, and code, is owned by Affordly and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute App content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on the App

You retain ownership of your receipt images and data. By using the App, you grant us a limited license to process your receipts solely to provide the service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED $50
• WE ARE NOT RESPONSIBLE FOR PURCHASING DECISIONS MADE BASED ON AI-GENERATED SAVINGS TIPS

10. Indemnification

You agree to indemnify and hold harmless Affordly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the App

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Effective Date." Your continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will cease immediately
• We may delete your account and associated data

You may terminate your account at any time by deleting it through the App or contacting us.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Affordly regarding the App and supersede any prior agreements.
